Clock Trademark Rights

Posted November 15, 2012

We at 1-800-4CLOCKS.com are always looking to protect our own trademarks, e.g. Museum Clocks™ and Gigantic Clocks™ – which is our new line of large display LED Clocks. Companies like 1-800-4CLOCKS need to preserve our intellectual property whether it is with grandfather clocks, wall clocks, mantel clocks, atomic clocks or LED clocks and other timepieces, like our newest GiganticClocks™ introduction.

In the United States you can establish trademark rights without registration based on legitimate use of the mark in commerce. However, owning a federal trademark registration on the Principal Register provides several advantages.

Registering clock trademarks gives constructive notice to the public of your ownership of the mark.

Trademarks alone give a legal presumption of your ownership and exclusive right to use the mark nationwide in connection with the goods and/or services listed in the registration.

The clock registration trademark certainly aids in the ability to bring an action concerning the mark in federal court.

The use of the USA clock brand name registration can be used as a basis to obtain registration in foreign countries, and it provides the added ability to file the U.S. registration with the U.S. Customs Service to prevent importation of infringing foreign goods.
